Uncontested Divorce With Children

Uncontested divorces are most common for couples with no children. However, there is nothing preventing a couple with children to go the uncontested route. If you can come to an agreement jointly without much fighting this type of divorce can be much less painful and much more affordable.

An uncontested divorce is uncommon when children are involved. It still will require papers to be filed in the court system. However, the couple that is divorcing will come to an agreement on what will happen as opposed to a judge. Attorneys may still need to be present to ensure that all paperwork is filed the way it should be.

With Children

When there are children involved, the family itself will often need to be interviewed by a person that the court appoints. It is the appointed party’s decision what is in the best interest of the children when it comes to child support and custody. The couple has the right to agree to these terms or get the court system further involved if they do not agree.

The Pros and Cons

An uncontested divorce will cost a lot less money because so much less time is spent in court. There is also typically a lot less conflict involved with an uncontested divorce. In certain cases, an uncontested divorce could be a bad idea. This is when any of the children require additional care or if the spouses are bound together financially through debt or real estate. In cases of abuse this is also not an ideal way to end things.

For the Children

An uncontested divorce is often very beneficial for the children. They will be able to see their parents working together even if they are separating. While a divorce is often a very difficult time for a child it is made much easier when there is less court time.
